When it comes to the use of a DMCA counter notice, these should only be filed if you are 100% confident that there is no infringement. If a counter notice is filed with incorrect information or assertions, it could result in civil or criminal penalties per our DMCA counter notice policy. When this situation occurred, did you receive a performance notification with contact information for the rights owner, and have you attempted to reach out for a retraction?
Retractions are not always granted, if a rights owner feels this is a valid infringement, they are not obligated to respond to any requests. If you are unable to obtain a retraction, or if a counter notice does not fit this situation, per our intellectual property policy for sellers you will need to resolve this externally and may need to involve your legal council.
