Trademark Violation - Not My ASIN

I received a Product Policy Compliance Violation for a trademark violation (the trademark was allegedly used in the product description).

However, I have never sold a product under that ASIN, and the item title is not anything I sell.

I opened a case with Amazon support, and their reply is "Please be informed that, since you have deleted the ASIN and you will not sell them again, no further action is required from your end for these listing."

But I never deleted the ASIN because I never had a product associated with it in the first place.

I don't want the violation counted against me, but at this point, should I take additional steps to get it removed, or just quit worrying about it since Amazon seems to think that I deleted the listing?

I understand you have recently received a trademark violation and have concerns as you did not sell the item.

Even if you have never sold the item in question, was there a time when you considering selling it? Was it an item you do not remember listing, from years ago?

Per the Intellectual Property policy for sellers, Amazon holds intellectual property within high regard. When registering and agreeing to terms of service, the Code of Conduct, and the Business Solutions agreement, sellers are also required to follow state, local, and federal laws plus the applicable Amazon policies.

In order to respond to the violation where there is a trademark located within the product detail page, you do have to remove the trademarked term from the detail page so there is no longer infringement present. After that, you do need to submit an appeal via the account health page to provide an update on how you have addressed the said infringement.

If there was an error made and you do not believe this violation is valid, you may also submit information and reasons as to why this is not correct.

You always want to address the violations present on the Account Health page as they will eventually impact your Account Health Rating.

I hope this helps you in addressing the violation. If you do have further questions, please continue to utilize this thread as the forums community and I are here to support you.

@Stevie_Amazonjust want to bring up an issue with this. If you create an offer on an ASIN, never add inventory, never sell it, and then deleted it from your inventory, will you still be hit with a trademark violation if a black hat comes along after the fact, hijacks the listing, and misuses a trademark?
