Confused about Trademark required.

Hi,

I am just started with AM as a seller and am selling products that we have created and own. We are not reselling anything previousy owned by anyone. We now have a Seller account and am trying to get started to sell.

We don't have a Trademark logo as such that is registered, however our company is a registered Pty Ltd company.

I am confused about need a Trademark.

Can someone clarify in easy terms.

Hello

There are 2 types of Trademarks. A trade mark name and a trade mark logo.

You can apply for both through IP Australia and much less cost to you if you do yourself as application is quite simple.

It depends on you if you want a trade mark and what your intentions are with your business. If you looking to run your business long term and want to protect both your name and designs.

A trade mark name will give you the opportunity for you to join brand registry on Amazon and create a Store front. Also to list products as your own brand I believe you cannot transition from generic to your brand name unless the product or packaging of your product has your logo printed on or permanently attached.

A trade mark logo once applied for and successful you can print on your product/packaging. You can also include your logo on your listing photos (except the main photo). By doing this it will help safeguard you from others or people hijacking your listings. Because when others sell or take over your listing they are also inheriting your photos. So if they are using a photo of yours that has your logo on it the are violating the consumer law because they are using your intellectual property without your consent.
