Counterfeit without a Test Buy

@Dougal_Amazon Hi Dougal,

Thank you for take a look at my case. Per other seller create to report IP on the product that I sell on amazon, even my account was ungated. All of these report was Counterfeit without a Test Buy.

I submitted all of the invoice documents and appealed so many times.

I outsourced the pictures to a visual design team and used infringing pictures without knowing it. As a novice seller, the platform should be tolerant and provide some support and guidance to novice sellers to avoid violations. And I also edited the pictures on the page to ensure that there would be no violations!

I also explained in detail in action plan that I am a novice seller.Hope to be tolerant!

Regarding the situation was the account put at risk or deactivated? I additionally am unable to access your complaint ID provided, can you provide more information surrounding these complaints?

Regarding being "ungated" I would advised looking over our products that require approval help page, as you may be allowed to use the listing, but are required to ensure you meet all compliance and related policies such as seeking permission to use another individuals intellectual properties. This additionally applies to products that dont have an approval process or requirement.

Did your pictures include another brand, or logo from another company? Typically, in these situations removing the violating images would ensure the listing is compliant, but does not remove the violation that occurred thus we need documentation.

When it comes to invoices, we suggest reviewing the responsible sourcing help page to ensure they meet our expectations. Depending on brand that issued the complaint and the product sourced, if they do not match, invoices may not be accepted. If documentation cannot be provided, some situation will allow you to acknowledge the violation through the account health page after deletion of the ASIN. Please keep in mind that this option is not always granted if offered, and is not offered in all situations.

A plan of action will not provide the required information to show proof that the violation did not occur. This may help explain the situation but we will still require proof of compliance.

If these issues cannot be addressed and the account "has not" been deactivated, they will fall off the account health rating after 180-days. If the account was deactivated due to these issues, they will need to be resolved with the above mentioned documentation or retraction from the rights owner for the eligibility of reactivation. You can additionally see more on these requirements at our intellectual property policy for sellers help page.
