Amazon’s policy on selling infant formula in Australia

What is an infant formula and follow-on formula?

Infant formula product means a product based on milk or other edible food constituents of animal or plant origin which is nutritionally adequate to serve by itself either as the sole or principal liquid source of nourishment for infants, depending on the age of the infant.

Infant formula means an infant formula product that:

  • is represented as a breast-milk substitute for infants
  • satisfies by itself the nutritional requirements of infants under the age of four and six months

Follow-on formula means an infant formula product that:

  • is represented as either a breast-milk substitute or replacement for infant formula
  • is suitable to constitute the principal liquid source of nourishment in a progressively diversified diet for infants from the age of six months

What is Amazon's policy on selling infant formula?

To sell infant formula on Amazon, we require that you provide documents that show that the product meets all local regulatory requirements. Amazon’s policies require that all infant formula sold through Amazon meet specified certification standards that are provided below.

What information and documents do I have to submit to be compliant?

To meet Amazon’s policy requirements, you must show that all the infant formula or follow-on formula you sell through Amazon meet specified certification standards by submitting the following information or documents for review to obtain approval to sell.

  • Company name
  • Seller or vendor ID
  • Email address
  • Phone number
  • A list of ASINs that you are applying to sell
  • All side product images (images should include all relevant labelling information as required by applicable Food Regulations or Food Standards)
  • One of the following: Global Food Safety Initiative (GFSI) equivalent, or Good Manufacturing Practices (GMP) or Hazard Analysis Critical Control Point (HACCP) certificate
  • Letter or certificate of compliance with local regulation

Documents that you submit must comply with the following requirements:

GFSI certificate Must be issued by an accredited third party inspection service with the name and address of the manufacturer.
Must contain reference to GFSI Program British Retail Consortium Global Standards (BRCGS), CanadaGAP, FSSC 22000, Global Aquaculture Alliance BAP, GlobalGAP (formerly EurepGAP) Program, Safe Quality Foods (SQF), International Featured Standard (IFS) and PrimusGFS.
Must include the registration number, certification date and the expiration date must not be in the past and should cover the ingestible product that you are applying for.
Good Manufacturing Practices (GMP) certificate Must be issued by an accredited third party inspection service with the name and address of the manufacturer.
Must contain reference to the appropriate local or international standards.
Must include the registration number, certification date and the expiration date must not be in the past.
Hazard Analysis and Critical Control Point (HACCP) certificate Must be issued by an accredited third party inspection service with the name and address of the manufacturer.
Must contain reference to the appropriate local or international standards.
Must include the registration number, certification date and the expiration date must not be in the past.
Product label Must contain all the sides of the product label to show all the mandatory labelling information.
The label should be compliant and in the local language of the marketplace that you are applying for.
Letter of compliance with local regulation Must contain the legal entity name, address, contact details and the date of letter should be recent, maximum three months before application or listing date.
Must contain the statement "in compliant with all applicable [marketplace that you are listing your product in] laws and regulations including but not limited to labelling regulation for [product you are applying for]".
Must have the date marking of food items and must follow Australia New Zealand Food Standards Code - Standard 1.2.5 - Information requirements - date marking of food for sale.
Must include the signature from the supplier.

Note: You certify that all materials you submit are true, authentic and accurate. Amazon may remove your selling privileges for failing to meet these safety requirements.

Consequences of policy violations

Violations of Amazon's policies for listing infant formula may result in, but may not be limited to the following actions:

  • Cancellation of the listing
  • Suspension of listing privileges
  • Cancellation of listing privileges
These potential consequences are in addition to, and in no way limited to, the consequences allowed by any agreement between Amazon and the seller. Amazon reserves the right to make judgements in its sole discretion about whether or not a listing is appropriate.
